Court Decision Does Not Affect This Season’s Open Enrollment

Late Friday night, December 14, U.S. District Judge Reed O’Connor agreed with a coalition of Republican states that, since earlier this year Congress repealed the tax penalty for not having health insurance, the entire Affordable Care Act (ACA) is unconstitutional.

So what does this mean for you?

Right now, nothing. If you purchased or renewed your ACA coverage for 2019, you are still covered. The decision does not immediately impact the ACA or our members’ 2019 health plans. This action by the court will be challenged and the legal battle will likely last at least the next couple of years.

Until there is a final decision, Florida Blue will continue to offer ACA coverage in every county of the state. You can count on us to be here when you need us, just like we’ve been serving you and your neighbors in Florida for the almost 75 years.
